How to answer problem questions in a OCR Law exam?

All problem questions (20 marks) should follow this structure:

1. State the Law – Write down the relevant legal rules.

  • For murder → include actus reus and mens rea
  • For negligence → include duty of care, breach, and causation

2. Apply the Law to the Scenario– Apply each part of the law to the facts.

Top tip:

Deal with each incident separately — this helps you gain more marks.

Example:

  • Incident 1 → apply actus reus + mens rea
  • Incident 2 → apply actus reus + mens rea

3. Conclusion

State the outcome clearly:

  • Will the defendant be guilty?
  • Will they be liable?

Simple rule to remember:

Law → Apply → Conclude

Most law questions require applying law to a scenario.

Use IRAC:

I – Issue

Identify the legal issue.

R – Rule

State the relevant law or case.

A – Application

Mistake1:Do not read the question properly- look at the command words for example:

Explain/ Describe needs just an explanation of the law with some legal authorities or examples.

Mistake2: Students forget to use legal knowledge.

Use your knowledge of the law in Section B questions.

Both problem questions and evaluation questions require legal knowledge.

Exam tip: Write down all your legal knowledge first.

Remember: Up to 8 marks are awarded just for showing your knowledge

Mistake3: Students don’t use the correct structure.

For evaluation questions, use this exam technique:

  • Make a point
  • Develop the point
  • Expand it using “Furthermore” or “However”

This structure helps you write stronger answers and gain more marks.
